Refunds and Returns Policy

We will only refund or exchange products purchased via this Website (https://greendoorliving.com.au) where required under Australian Consumer Law. Refunds and exchanges are subject to the following terms, conditions and notices (Refunds and Returns Policy). This Refunds and Returns Policy forms part of the Terms and Conditions of Purchase (https://greendoorliving.com.au/pages/website-terms-and-conditions-of-purchase) applying to the purchase of products via this Website.

1        Consumer rights

As a consumer, you are entitled to the benefit of statutory consumer guarantees under the Australian Consumer Law in respect of products purchased from us which cannot be excluded, limited or modified this Refunds and Returns Policy.

2        Change of mind (not allowed)

Please choose carefully before you buy because we do not give refunds or exchanges if you have simply changed your mind about buying the product.

3        Faulty products

3.1     Definitions

A major problem means there is a problem with the product, and the product:

(a) would not have been bought by a reasonable consumer who knew about the problem;

(b) is significantly different from the description, sample or demonstration model;

(c) is substantially unfit for its usual purpose, and it cannot be fixed easily in a reasonable time;

(d) is unfit for your particular purpose which you told us about prior to us accepting your order, and it cannot be fixed easily in a reasonable time;
or
(e) is unsafe.

A minor problem means there is a problem with the product which is not a major problem.

In relation to natural crystals, a problem does not include the unique and individual characteristics referenced in the description of the product and clause 2.2 of the Terms and Conditions of Purchase. These are natural characteristics of which you are taken to have been given notice prior to purchasing the product.

3.2     Remedy – major problems

If there is a major problem with a product (which is not excluded by clause 4.1), we will, at your election:

(a) refund you; or

(b) exchange the faulty product with a replacement product (if possible).

3.2     Remedy – minor problems

If there is a minor problem with a product (which is not excluded by clause 4.1), we will, at our discretion:

(a) refund you; or

(b) exchange the faulty product with a replacement product (if possible).

4        Other terms and conditions

4.1     No consumer guarantee

We do not need to repair, exchange or refund a product if:

(a) the problem with the product was caused by neglect, abnormal use, your actions or an accident that happened after you bought it; or

(b) you were alerted about the problem before you bought the product.

To determine the cause of the problem, we may investigate the problem or request that the problem be investigated by an appropriate third-party.

4.2     Inspection of products on delivery

You must inspect the products immediately upon their arrival in accordance with clause 5 of the Terms and Conditions. If you do not comply with this provision, you may not be entitled to a remedy under this Refunds and Returns Policy.

4.3     Time to return faulty products

You must return faulty products within a reasonable time in which it would be expected that the fault would become obvious, considering the type of product, your likely use of it, the length of time it would reasonable be used, and the amount of use reasonable needed before the fault becomes apparent. We are not required to refund or exchange the product after this time.

4.4     Returning products

You must return the product with a problem (which is not excluded by clause 4.1) before any refund will be processed. It does not matter whether the product is:

(a) opened;
(b) used;
(c) altered;
(d) worn;
(e) washed;
(f) in its original condition, packaging or shrink wrap; or
(g) bearing its original tags or seals.

You must return with the product with all manuals, accessories and documentation (including certificates) that came with it.

You retain all risk of loss or damage to the products until we have received and inspected them.

4.5     Proof of purchase

You must show your proof of purchase when asking us to refund or exchange a faulty product.

If you cannot show adequate proof of purchase and we are not satisfied that you bought the product from us, we reserve our right not to refund or exchange a faulty product.

4.6     Refund method

We will only make refunds using the original payment method.

4.7     Delivery charges

Unless otherwise required by law, we will not refund delivery charges. You must also pay the delivery charges to return the product.

4.8     Rejection of refund or return

If we assess that the product does not meet this Returns or Refunds Policy, we will contact you and then return the product to you. You must pay the delivery charge for us to return the product to you.

5        Privacy

5.1     Requesting information

We will ask you for relevant information when you return a product. If you do not provide this information, we may not be able to process your request under this Refunds and Returns Policy.

5.2     Storing and using your information

Your information will be stored securely for a reasonable time and used in accordance with our Privacy Policy (https://greendoorliving.com.au/pages/privacy-policy). Among other things, we may use your information to investigate and protect against fraud, and for analysis.

5.3     Disclosing your information

We may disclose your information if required by law, or the order of a court or tribunal.

9        Complaints

We operate a complaint handling procedure which we will use to try to resolve disputes when they first arise. Please let us know if you have any complaints or comments.

10      Severability

If any clause or part of a clause of the Refunds and Returns Policy is illegal, invalid or unenforceable (Offending Clause) in a jurisdiction (Offended Jurisdiction), then in that Offended Jurisdiction:

(a) where the Offending Clause can be read down so as to give it a valid and enforceable operation of a partial nature, it must be read down to the extent necessary to achieve that result; and

(b) in any other case, the Offending Clause must be severed from the Refunds and Returns Policy and the Refunds and Returns Policy operate as if the Offending Clause had not been included.

This section must be interpreted so that the legality, validity or enforceability of:

(c) in the case of the Offended Jurisdiction, the Refunds and Returns Policy excluding the Offending Clause; and

(d) in any other jurisdiction, the whole Refunds and Returns Policy,

will not be affected and remain in full force and effect.

11      Applicable law

The laws of Queensland apply to this Refunds and Returns Policy. You agree to submit to the exclusive jurisdiction of the courts of Queensland.
